Breyer: Founding Fathers Would Have Allowed Restrictions on Guns
If you look at the values and the historical record, you will see that the Founding Fathers never intended guns to go unregulated, Supreme Court Justice Stephen Breyer contended Sunday.
Appearing on “Fox News Sunday,” Breyer said history stands with the dissenters in the court’s decision to overturn a Washington, D.C., handgun ban in the 2008 case “D.C. v. Heller.”
Breyer wrote the dissent and was joined by Justices John Paul Stevens, David H. Souter and Ruth Bader Ginsburg. He said historians would side with him in the case because they have concluded that Founding Father James Madison was more worried that the Constitution may not be ratified than he was about granting individuals the right to bear arms.
So when the next SCOTUS Appointment comes up and it’s a swing justice do you believe the judges will be pro 2nd amendment? The UN is already trying to remove our rights, Hillary Clinton, Barrack Obama and the entire progressive side of the Democrat party want us disarmed. The only thing between those visions and our nation being disarmed is the SCOTUS.
IF we don’t have a conservative POTUS, we are at the mercy of the courts. So in the elections I beg you to consider the long term damage a progressive POTUS does. I beg you to consider the long term actions of short term leaders.
There has not been an uprising in the USA for a very long time, if they succeed in taking our arms, the will of the people will be silenced and we will become sheep. Then it’s too late for “Maybe we shouldn’t have done that”
This justice Breyer is ignorant of the facts. He is a liberal and he uses the constitution when it suits his argument. He discards it when his ideology is counter to it.

1. Should gun stores be held responsible for crimes committed with weapons that they have sold?

Now when I took the poll, the thing that bothered me was 48% said yes. WTF?
So I guess:
A car dealership should be held accountable for wrecks and drunk drivers.
The pound should be held responsible for any dog bites.
7-11’s should be held accountable for any fires that were started by a bic lighter.
The hardware store should be held responsible for the robbery where a hammer was used to break in to the residence.

How is it that Americans are becoming DUMBER? What the hell is wrong with people? 48% of the people that took that poll just removed all doubt that idiocy is rampant in our nation. Anyone that would suggest that a gun store is responsible for the actions of a customer has no clue about the word “responsible:” Responsibility is a two way street. IF the gun store followed the “LAW” and sold the firearm LEGALLY, they have met the criteria to do business.
The customer is RESPONSIBLE after he/she purchases the firearm. IF he/she decides to commit a crime after he/she walks out of the store, how is the gun store responsible?

With the beautiful Atlantic Ocean whitecapping out my hotel window on Ft. Lauderdale Beach this fine American rock-n-roll summer morning, the only thing more beautiful is my handsome, oh so utilitarian Glock Model 20, 10mm semi auto pistol and twelve loaded high capacity magazines sitting on the little table next to me. Iâm on my 47th year blitzkrieg rock-n-roll tour across America. I have many guitars, oversized amplifiers and plenty of guns and ammo. The American Boy Scout lives. Prepared is good. Unprepared is for losers. Know it.
By all intellectually honest considerations, my gift of life qualifies as Supreme, and not only worthy of defending, but clearly demanding to be defended by all moral beings.
And speaking of losers, sadly and frighteningly, some weasels made their way onto the so called Supreme Court who apparently do not agree with me. Fortunately, I am a self made man, have a firm grasp of logic, self evident truth and its history, and I wait for no one to authorize my pure instinct to defend myself and loved ones. When in doubt, I whip it out.
And like many real Americans across this great country, while we are relieved and pleased with the McDonald ruling of five Supreme Court Justices, I am absolutely appalled that any clear thinking human being, much less an American sitting on the Supreme Court of the United States, could possibly believe that individual Americans have no right to self defense. That four of the nine Supreme Court justices believe this, is a monumental indictment against the very precepts of the American experiment, the premise of God given individual rights, and a cruel bastardization of our sacred US Constitution and Bill of Rights.
If anyone thinks for one minute that I am waiting for Miss Ginsburg or anyone else to give me the green light to practice the religion of my choice, or to speak my individual mind, or to write what I damn well please in song or on the pages of newspapers, magazines or websites, they have another painful think coming.
Headsup blackrobers, I am in charge of my life, survival, thoughts, statements, writings, religious practices and without a shadow of a doubt, my God given individual right to keep and bear arms to defend myself from evil in any shape or form. And with all due respect, I see and know clear and present evil in tyranny, dictatorships, Emperors, kings, despots, slavedrivers and the history of abuse of power. And I defy it out of hand.
If ever there was an abuse of power, it would be most egregious when people are voted into public office by we the people of America, and those elected people have the audacity to attempt to deny me the right to self defense, then have the unmitigated pomposity to steal more of my hard earned tax dollars to hire their own armed security detail with my money while forcing me into unarmed helplessness. It must stop now. Know it.
With the Mao Tse Tung fan club in the White House, a clueless, rookie president hellbent on spending like a maniac as unprecedented debt piles up all around him, and every other imaginable indicator of an America turned upside down, it comes as no surprise that this insane level of madness has metastasized into the Supreme Court where the Bill of Rights is being trashed by clueless, dangerously insulated old people, intentionally disconnected from the real world where the possession of a firearm so often means life and death for good, innocent Americans everyday of the year.
Whose side are these so called justices on?
To dismiss this self evident truth is to literally side with a failed court system and the evil perpetrators of its insidious engineered recidivism, virtually guaranteeing stacks of dead victims at the hands of released monsters, while the Supreme blackrobers go about their professionally protected little lives.
Tell me these four Supreme Court justices donât know this. Tell me they qualify to have any variation of the term justice associated with their names in any way, shape or form. Tell me you believe in forced unarmed helplessness of good American families. Tell me you care. Ask me if I do.
We better get crackin America. The SCOTUS indecision on the Second Amendment (and I donât want to hear about the close call) is further proof that The American Way is being attacked like never before. I hope all Americans are raising hell like I am, letting elected officials know that we are deeply offended at the course America is currently on. Fedzilla in all its ugly forms is beyond out of control. The Mao Tse Tung fan club is moving forward at a breakneck pace to fundamentally disassemble the American Dream. They must be stopped.
This blatant disregard for the most basic human right and instinct to self defense is as bad as it gets. It is time to clean house. Time for real hope and change. I hope we change back to the real America as fast as possible. My life is worth protecting, and my American Dream is worth fighting to get back.
Keep means its mine, you canât have it. Bear can only mean one thing; Iâve got some on me right here, right now. Shall not be infringed also needs no interpretation, unless you just donât get it. Get it. And get it right.
If you can’t grasp that logic, then sit back shut up and keep your ass out of any election or public office. The rest of us will act on your behalf.
While some of us are dancing in the streets over this ruling, I suggest you step back and look at exactly what’s happening.
Gun rights extended by Supreme Court
WASHINGTON — The Supreme Court held Monday that Americans have the right to own a gun for self-defense anywhere they live, advancing a recent trend by the John Roberts-led bench to embrace gun rights.
By a 5-4 vote, the justices cast doubt on handgun bans in the Chicago area, but signaled that some limitations on the Constitution’s “right to keep and bear arms” could survive legal challenges.
Justice Samuel Alito, writing for the court, said that the Second Amendment right “applies equally to the federal government and the states.”
Here’s where we are headed under the current structure of leadership.
Justices John Paul Stevens and Stephen Breyer, joined by Justices Ruth Bader Ginsburg and Sonia Sotomayor, each wrote a dissent. Stevens, in his final day on the bench after more than 34 years, said that unlike the Washington case, Monday’s decision “could prove far more destructive – quite literally – to our nation’s communities and to our constitutional structure.”

It should be noted that, in the guns case, the Court says explicitly in Alito’s opinion that it would not reconsider the Slaughterhouse cases, which almost completely deprive the Privileges or Immunities Clause of any constitutional meaning.
The opinion leaves the fate of the Chicago gun ordinance in the hands of the 7th Circuit on remand.
What we have won is a stay of execution, the Chicago gun ban was decided by a 5-4 margin, with one of the dissenting judges being Sotomayor. Sotomayor on her confirmation hearing about the 2nd amendment, and if she thought Americans should be allowed to own firearms. She answered YES, and then becomes a dissenting vote on this major gun rights case.
I ask you real Americans, how long do you think Ginsburg can hang on? How long do you think it will be before Obama appoints a SWING judge? The next appointment will be the deciding factor for our freedom and if we allow Obama to make that choice we better be ready to fight and die for American values because that’s what is going to happen.

The governor just signed the law, so it’ll take effect in a few months. Two other states, Alaska and Vermont, already have similar rules. There are two caveats. One, people carrying concealed must tell police if they’re asked. Also, police can temporarily take a concealed weapon from a person, even during traffic stops, the Arizona Republic reports. No gun-safety classes will be required.

Months ago we were bombarded by the Brady Campaign’s ruthless attempts to ban the open, lawful carry of firearms in public places such as Starbucks. Determined to remain on the outskirts of the debate, the coffee giant chimed in to issue a statement declaring its acceptance and compliance with State law. In California it is quite legal to openly display a firearm as long as the weapon is unloaded and holstered.For now.
Democratic assembly-woman Lori Saldana of San Diego has authored a bill which would effectively eliminate the open carry of firearms. A shocking twist in the debate over California gun rights, such measures would ultimately remove the ability of Californians to defend themselves from like threats. As many residents and non-residents are aware California is already a âMay-Issueâ State with regards to concealed carry licensing and now their only means of lawfully carrying a firearm is under attack. While open carry advocates have urged their legislators to make concealed carry and other laws to put those who are scared by the sight of an openly-toted, unloaded firearm at ease, responses from the Assembly have been more reactionary than pro-gun advocates expected.
“What I’m concerned about is people who have no training can carry a gun for no other purpose than to make a public statement,” said Saldana. Up until the present all political statements issued have been peaceful. With no other alternatives available, gun owners have adopted the only lawful means of protecting themselves when law enforcement is not readily available to intervene during a forcible felony in progress.
Law enforcement disagrees with such personal responsibilities; the California Police Chiefs Association has signed on as a sponsor of the bill. Emeryville Police Chief Ken James issued the following statement: “Officers are taught from day one in the academy that guns are a threat… This open carry places officers in a position between a rock and a hard spot.â

So neighboring states differ by that much? Oh and one of the two states are releasing FELONS because of overcrowding. Can you guess which one? Here’s another tidbit of info, our elected officials here in California are disarming the public, freeing Felons, coddling Illegals, taxing business to extinction, but now the next step is climate-gate, they are close to passing a law that bans chemicals used in the manufacture beverage/food containers. Then it will be banning cold medicine because of the “Meth” issue.
What that says is our liberal demorats have NO PROBLEM at all banning anything, they believe YOU don’t know shit, and YOU can’t control yourself, you must not have temptation, nor anything that can be construed as harmful. BUT they haven’t banned cars yet.
What we have here is a tale of two states, one believes in the American way of life, the other believes Government should control your every move. You decide which state you would rather live in. But keep the faith guys, California sends 53 reps to the house of Reps in order to help the nation “progress”…. đ
How damn difficult is it to see what our founders intended? The SCOTUS is right now deciding a very ridiculous case, and it just boggles the mind that it’s even in the courts hands at all.
The second amendment: “A well regulated militia being necessary to the security of a free State, the right of the People to keep and bear arms shall not be infringed.”
This is a perfect document, no problem defining it.. it is PERFECT. That’s a fucking period! (Excuse me, I live in California and our idiots in the state legislature have decided that “Not Cussing” week was more important than “Not having a job decade” so I may cuss a little in protest of those fucking morons.)
